In a letter addressed to the Registrar of the Commercial Division of the High Court, Kampala Associated Advocates (KAA), the property mogul’s lawyers have told the Registrar that the time within which BOU can file a defense has elapsed. “To this end, the Counterclaimant is out of time within which to file a reply.” Reads part of the letter filed on the 29 August. The letter continues to read as follows: “On the 28 August, we carried out a search in the register at the Commercial Court and established that the Counterclaimant had not filed a reply to the Counterclaim.” This further dents BOU’s case many senior lawyers and policy makers had branded weak, full of narratives and conjectures and completely unnecessary. A source at BOU preferring anonymity informed us that BOU’s intention was never to arrive at the truth but corner Sudhir into surrendering his prime properties. They are still praying that the Court process is avoided.” A Kampala top lawyer has told us that “in civil cases, court will usually decide such a case with one party. The other party won’t be listened to unless they are granted to file a defense outside time.”
