(ISO) DIRECTOR GENERAL, COL FRANK KAKA BAGYENDA IN DEEP TROUBLE

THE director General of Internal Security Organization (ISO) Director General, Col Frank Kaka Bagyenda is in deep trouble for arbitrary arresting and detaining people with trial.


The Uganda Law Society (ULS) has threaten to  take him (Kaka) to court accusing him of sanctioning abductions of people and holding them incommunicado in illegal un gazetted places

A case in point is the arrest of Movit Products CEO, Simpson Birungi who has been in ISO detention for more than a month.

Birungi, commonly known as ‘Movit’ was on June 7, 2018 arrested by unidentified armed men before being detained a suspected safe house in Kyengera allegedly run by the Internal Security Organization (ISO)

 He (Birungi) was arrested by ISO operatives on the orders of Kaka as he left CID Headquarters to respond to bond conditions after an earlier arrest by police over murder allegations
ULS is demanding that Kaka personally explains why and where ISO is currently illegally and contemptuously holding Birungi in the face of clear violation of provisions of the law. {googleads right}

The ULS boss Simon Peter Kinobe in a statement issued today Thursday July 12, 2018 and obtained by Eyewitness24, ,  said the DPP should immediately investigate and prosecute these transgressions of the law by ISO and Kaka,
“If the DPP is unwilling or unable to call the individuals in this case to book, ULS will consider commencing private prosecutions against the individuals concerned including but not limited to Col. Frank Kaka Bagyenda for abduction with intent to confine contrary to S.244 of the Penal Code Act Cap 120, wrongfully concealing an abducted person contrary to S.247 of the Penal Code Act, Wrongful confinement contrary to S.248 of the Penal Code Act,”, Kinobe said.

 He said , the continued detention without trial  Birungi by ISO contrary to the express orders of the High Court order by justice Musa Ssekaana  remains a matter of grave concern to all peace loving and law abiding  Ugandans
Birungi’s family on June 11, 2018 through lawyers from Nyanzi, Kiboneka and Mbabazi advocates petitioned the High Court civil division court seeking for orders of a habeas corpus against the ISO Director General, Inspector General of Police, the Chieftaincy of Military Intelligence and the Attorney General to have Birungi produced in court dead or alive.{googleads right}

In his ruling, Justice Ssekaana noted that Birungi is detained at Kyengera, a place which is not known to be a gazette place authorized by law under article 23(2) of the constitution for such a purpose before ordering for his immediate release.
“The law gives powers to this court in exercise of its discretion to make an order that the person restrained be released from the illegal detention in accordance with rule 6 of the judicature (Habeas Corpus) Rules,” Justice Ssekaana ruled.

However, ISO and Kaka have contemptuously refused to release Birungi  as directed by court nor allowed him access to his lawyers and family.

Now ULS want the Director of Public Prosecution (DPP) to take action against Kaka, or else, they (ULS) will sue Kaka without any further notice.
