Long Waited Judgement in Anti Homosexuality Act Case is Tomorrow!

The Judgment in the case filed by activists seeking to nullify the Anti Homosexuality Act of 2023 for criminalizing consensual sex among same-sex adults has been set for tomorrow.

The date was announced by  the Deputy Registrar Susanne Okeny Anyala who issued  notices to 11 Law firms that represented  the applicants in the  four Petitions filed against the Attorney General and Pastor Martin Ssempa.

On 18th December 2023, a panel of five Justices including Deputy Chief Justice Richard Buteera, Geoffrey Kiryabwire, Muzamiru Mutangula Kibeedi, Monica Mugenyi, and Christopher Gashirabake concluded hearing of four consolidated petitions and promised to deliver their judgment on notice.

Last year various groups, including West Budama MP Fox Odoi and seven others, Makerere University Professor Sylvia Tamale,  Dr Busingye Kabumba and seven others, Lawyer Robert Rutaro and three others, and Bishop James Lubega Banda petitioned Constitutional Court seeking to nullify the removal of the law criminalizing consensual sex among same-sex adults.

The petitioners argue that the Anti-Homosexuality Law, apart from imposing severe penalties such as death and heavy fines, infringes upon constitutional articles relating to personal freedoms, human rights, and dignity while hindering the fight against HIV/AIDS.

The disputed law was assented to by President Museveni on May 26th 2023.
